TERMS OF USE AND SERVICES

Welcome to the Terms of Service for 4Ever Sea website and any associated services. This is an agreement (“Agreement”) between, 4Ever Sea, the owner of 4eversea.com (the“Site”), and you (“you”, “your” , “user(s)” or “client(s)”), a user of the site, software, and service.

Throughout this Agreement, the words “4Ever Sea,” “us,” “we,” and “our,” refer to our company, 4Ever Sea and our site, software, or any services, as is appropriate in the context of the use of the words. Your ability to submit or transmit any information to the site and service, including but not limited to text, photos, pictures, comments, designs, data, or videos will be referred to as “content” throughout this Agreement

By using our site, service or any software you agree to these Terms of Service and our Privacy Policy. We may amend our Terms of Service or Privacy Policy and may notify you when we do so.

If you do not agree to the Terms of Service or the Privacy Policy please cease using our software, site and service immediately. Users of our service must be 18 or above. If you are under the age of 18 please stop using our site and service immediately.

INTRODUCTION

4Ever Sea has developed the site and an online booking system (the “Online Booking System”) which enable individuals to browse and book (the “Booking”) accommodation and diving and snorkeling services provided directly by 4Ever Sea, including dives or diving packages, guided tours, diving safaris, courses, and equipment rental (the “Services”).

By browsing, accessing and using the site and by using the Online Booking System, you acknowledge and agree that you have read, understood, and agreed to these terms and conditions.

OUR SERVICES

4Ever Sea acts solely between you and the 4Ever Sea. The Online Booking System enables you to make a booking directly with 4Ever Sea and:

Booking created through the Online Booking System will constitute a direct contract between you and 4Ever Sea in accordance with the terms and conditions set out in the Booking, including but not limited to fees, costs, charges and taxes, and any cancellation or no-show charges (the “Cancellation Policy”) .

Information displayed on the site is based on information provided by 4Ever Sea. We do guarantee that the information is reliable, accurate, complete, and free from errors.

4Ever Sea may ask customers to comment on all aspects of the services, and may post such reviews on the site.

PRICES

All rates and prices listed through the Online Booking System include the entire cost for all services and charges related to the services, including but not limited to all surcharges, taxes.

EXCHANGE RATES

Exchange rates between available currencies on the site are updated every 30 minutes. When you book online and/or not pay a deposit you will be charged with the rate when you booked and indicated in the booking confirmation.

AVAILABILITY

Services displayed on the site are available for booking and subject to confirmation within 48 hours upon completing the booking through the Online Booking System, and:

For services expressed in units other than days, 4Ever Sea reserves the right to confirm availability on specific dates within the date range upon receiving the booking request. In the event that 4Ever Sea has limited availability during the date range specified in the booking, 4Ever Sea agrees to notify you immediately about the availability on specific dates within the date range so that you may plan accordingly or make alternative arrangements.

PAYMENT

All fees, costs, charges, and taxes with respect to services are payable to 4Ever Sea in the currency indicated in the booking confirmation. Once a user makes a booking using the Online Booking System regarding to the booked service whether have to pay a deposit or not and depending of the percentage of deposit the user will pay the rest of payment” if there is a rest of payment” with 4Ever Sea.

Booking Terms

General conditions of sale

1. Please note that all prices are subject to modification according to fuel increase, rate changes of Egyptian taxes or to an unfavourable exchange rate ( 1 (one) euro dropping to less than 18LE)
2. 4 Ever Sea is not responsible for late or cancelled flights and shall not accept charge for any costs related to the delay.
3. All participants are responsible for their personal belongings. The damage, loss or oblivion of their personal items shall not give rise to any appeal against 4 Ever sea.
4. In case of breakage or damage of the boat, or equipment on the boat, the responsible person will be charged according to the value of the damage equipment.

30 days before departure for all the participants

• Provide the name, number of passport, diver level and number of dives
• Details of flight and arrival airport
• Details of equipment rental (if needed) size of wet suit, fins…
• Private guides
• Courses
• Special needs
• Accept the payment conditions and the above noted general conditions of sale.

Payment terms

• deposit of 25% of the total amount on booking
• 100% due 30 days before departure

Cancellation fees

• + 90 to 60 days before departure = 25 % of the total amount of the trip
• Between 59 and 30 days before departure = 50% of the total amount of the trip
• Between 29 and 15 days before departure = 80% of the total amount of the trip

• 14 days before departure = 100 % of the total amount of the trip

Guaranteed departure

• Departures are confirmed with a minimum of 12 persons.
• If 30 days before departure, the boat doesn’t have the minimum required of participants, 4 Ever sea is entitled to cancel the trip.

Airport and transfers

From Marsa Alam airport

• transfer is included by minibus or bus depending on the number of participants.

Refund

No refund shall be given in case of modification of the itinerary because of:

• the weather conditions
• emergency situation
• situation that could endanger safety of the boat or the participants,
• measures by the Egyptian government or local authorities

The equipment rental (€)

The equipment rental is under the responsibility of the borrower.  Damaged or missing equipment will be charged :

– regulator : first stage: 200 – regulator second stage: 100

– pressure gauge: 120 – Stabilizing jacket : 250

– wetsuit 5 mm : 95 – belt : 10

– Mask 35 – fins 75

– computer: 350 – weigh 3/kg

– Analyzer O2 : 150

Cruising and sailing to diving and snorkeling sites is subject to weather and water conditions, the granting of authority permits and approval form governmental bodies.
